ComFestival Regulations

These Regulations [hereinafter referred to as the Regulations] describe the rules for the provision of services by Wiktor Kuśmierek, conducting business activity under the name RocketDeal Wiktor Kuśmierek, Al. Powstańców Wielkopolskich no. 6b lok. 9, 70 – 110 Szczecin, TAX ID: 9552572880, REGON: 525525408 [hereinafter referred to as We, Us], consisting in the provision of caravans and tents to guests of music festivals in a specially designated glamping zone [hereinafter referred to as ComFestival]. 

ComFestival is located on a fenced campsite, which is part of the grounds of a given music festival [hereinafter: Grounds], therefore ComFestival guests [hereinafter: Guests] are subject to the regulations of the organiser of a given music festival in addition to these Regulations. However, remember that these Regulations, in the scope of the services we provide, take precedence over the regulations of the organiser of the music festival.  

A visit to ComFestival does not mean participation in a given music festival. Participation in a music festival is only possible after purchasing the appropriate ticket on the website of the organizer of that festival. 

Moving a given music festival to another area will automatically result in moving ComFestival to the same area. We will try to inform you about such a possible transfer as soon as possible.

General rules

  1. Every person staying on the premises must comply with the provisions of the Regulations. 
  2. The terms used in the Regulations mean: 
    1.  Confirmation of Reservation, Reservation – by this we mean individual consent to enter the Area. After presenting the Confirmation of Reservation and proof of identity when entering the Area for the first time, you will receive a wristband [hereinafter: Identifier], which confirms your rights resulting from the Confirmation of Reservation, in particular the right to enter and leave the Area during the time for which we have made the Facility available to you, in accordance with your order;
    2. Object – a caravan or tent that we have made available to you as part of ComFestival, on the basis of these Regulations, for the period selected by you when placing the order; 
    3. You or You - we understand by this a ComFestival Guest, based on a valid Booking Confirmation or Identifier. A Guest may be an adult or a person under the age of 18, who is under the constant care of an adult (in the latter case - if the regulations of the organizer of a given festival allow it).  


Reservation

  1. ComFestival reservations are only available via the comfestival.eu website. 
  2. The price of the Reservation includes access to the type of Property you choose:
    1. 2- or 4-person caravan;
    2. 2-person tent. 
  4. When making a Reservation via the website indicated in section 1, you will be informed about the date of making the Property available and leaving it;  
  5. The fee for providing the Facility is charged immediately upon making the Reservation via the payment gateway located on our website comfestival.eu;
  6. Once we have processed your payment, a Reservation Confirmation is sent to the email address you provided. 
  7. The fee for providing the Facility will be increased by a deposit in the amount of: PLN 1,500.00 – in the case of renting a caravan and PLN 1,000.00 – in the case of renting a tent, collected at the ComFestival reception desk, which will be returned to you immediately after you leave and We have accepted the Facility without any problems. The deposit will be returned in the same form in which it was paid by you, subject to the provisions of point V. 2. 
  8. Available forms of deposit payment: 
    1. in cash at the ComFestival reception;
    2. by bank transfer: PL49 1140 2004 0000 3802 8564 0906;
  10. The resale of the Reservation at auctions, auctions or in any other manner indicating the profit-making nature of such resale is prohibited. Any public offer of transfer of ownership of the Reservation, including as a prize in competitions, lotteries, premium sales or any other promotions, even if it is free of charge, is prohibited. 
  11. The Booking Confirmation authorizing entry to the Area must be original and acquired in accordance with the provisions of the Regulations. Booking Confirmation acquired in violation of the provisions of the Regulations may be invalidated, which will result in the refusal to issue an Identifier and the inability to stay at ComFestival.
  12. Each Booking Confirmation has a unique barcode. The Booking Confirmation entitles you to a one-time issuance of an Identifier. Each entry to the Area is only allowed with an undamaged Identifier permanently attached to your hand. In the event of a damaged Identifier or the lack of its permanent attachment to your hand, you will not be allowed to enter the Area unless you show the Booking Confirmation, so take care of its condition. 
  13. In the event of making a Reservation for several people, a person whose data is not assigned to the Reservation Confirmation in a way that allows for their verification is entitled to enter the Area only at the same time as the holder of the Reservation Confirmation whose data is assigned to the Reservation Confirmation. In the case referred to above, the holder of the Reservation Confirmation whose data is assigned to the Reservation Confirmation is also obliged to enter the Area together with other persons who have shown/scanned the Reservation Confirmation in their presence.
  14. If you are under 18 years of age, you may stay at ComFestival under the supervision of an adult, provided that the organiser of the music festival within which ComFestival takes place allows this possibility. 


Refund or exchange of Reservation

  1. In accordance with the provisions of art. 38 section 1 point 12 of the Act of 30 May 2014 on consumer rights (Journal of Laws of 2024, item 1796), you cannot return the Reservation, except for the cases described below. Dz.U. z 2024 r. poz. 1796)​
  2. Refunds or exchanges of Reservations are only possible in the event of the cancellation of the music festival at which ComFestival is organized, for which the Reservation being returned was purchased, its transfer to another location or a change of its date. In such a case, we will send information about the possibility of returning the Reservation to the e-mail address you provided.
  3. Refund of the Reservation in the event of the music festival being moved to another location or the date being changed is only possible until the actual start date of the festival. After this date, it is only possible to initiate the complaint procedure, regardless of whether the Reservation Confirmation has been used. Requests for the refund of the Reservation submitted after the actual start date of the festival will not be considered.
  4. You can return your Reservation by sending an e-mail indicating the Reservation number to the following address: kontakt@comfestival.eu  
  5. The refund for the Reservation made will be made within 14 days of us receiving information about the intention to return. 
  6. Refunds for the Reservation will be made in the form in which the Reservation was made. 
  7. Unused reservations are non-refundable.
  8. The reservation entitles you to stay overnight in a designated glamping zone of the festival, therefore, any changes in the festival program do not entitle you to a refund or exchange of the Reservation.


Entry to the area

  1. Entry to the Venue is granted to persons in possession of a valid and unused Reservation Confirmation, which you must present on the first day of your stay at ComFestival in order to be issued with an Identification Card at the ComFestival reception.  
  2. You must wear the ID card on your hand throughout your stay at ComFestival and show it each time you enter the Venue. If you lose the ID card (or it is stolen) or it is torn, torn or otherwise damaged, you will not be allowed to enter the Venue unless you show your Booking Confirmation. 
  3. Only one person may use one Identifier.



Organizational and order rules in force on the premises

  1. All persons present on the Grounds are obliged to behave in a manner that does not endanger the safety of other persons present on the Grounds, and in particular to comply with the provisions of the music festival organizer's regulations in this respect. These provisions also apply on the ComFestival Grounds as a separate festival area. 
  2. The property should be returned in a condition that takes into account wear and tear resulting from normal use, cleaned and emptied of people and items. We charge additional fees for damages made to the Property, in accordance with the table constituting Annex No. 1 to the Regulations.  
  3. We are not responsible for property left in the Facility. 
  4. It is forbidden to use open fire and gas on the premises. We provide access to electricity for ComFestival guests.


Complaints

  1. Any complaints may be submitted in writing no later than 14 days after the end of the stay to our address: kontakt@comfestival.eu ; 
  2. The complaint should include your details, such as your name, surname and mailing address, so that we can send you our position regarding the complaint;;
  3. We have 14 days from the date of receipt of the complaint to consider it.
  4. By submitting a complaint, you consent to the processing of your personal data for the purpose of considering the complaint. The administrator of your personal data is Wiktor Kuśmierek, conducting business activity under the name RocketDeal Wiktor Kuśmierek, Al. Powstańców Wielkopolskich nr 6b lok. 9 70 – 110 Szczecin, TAX ID: 9552572880, REGON: 525525408.
  5. Providing personal data is voluntary, but necessary to receive a response to a complaint. The legal basis for processing personal data is their necessity to achieve the purposes resulting from the legitimate interests pursued by the administrator, consisting in considering complaints. The administrator may process your personal data for as long as it is necessary to achieve the purposes for which the data was collected, unless there is a technical, legal or other important reason justifying the deletion, destruction or anonymization of this data.
  6. You have the right to request from the administrator access to your personal data, its rectification, deletion or restriction of processing, the right to object. 


Final provisions

  1. We are not responsible for the effects of Force Majeure. Force Majeure is any event beyond Our control that makes the performance of obligations impossible or that may be considered impossible or inappropriate due to the circumstances. Force Majeure includes in particular: weather conditions, failures or disruptions in the operation of devices supplying electricity, light, acts of war or actions of state or local government authorities in the field of formulating policies, laws and regulations affecting the performance of obligations.
  2. These Regulations are available: on the website comfestival.eu/terms and at the reception, at the entrance to the Area.
  3. In matters not regulated in the Regulations, the provisions of generally applicable law shall apply.
  4. The regulations enter into force on 15/03/2025 
  5. These Regulations may be changed by us. We will inform you about the planned change 14 days in advance, posting it on the​ comfestival.eu/terms website in a place visible to you before placing an order. For orders placed before the date of entry into force of the changes, the previous provisions of the Regulations shall apply.
  6. In matters not regulated by these Regulations, the provisions of the regulations of the organiser of the given music festival shall apply. 


Appendix No. 1 - fees for damages caused to the Facility.
